Actually I think Spitzer has his hands full with the abuses and crooks in high finance where he seems to be doing a great job. Editor's Note: I have no problem with Indians (er Native Americans) not charging sales tax. Again, the impetus is on me as the consumer to report it/pay the taxes to the State. Mr Spitzer should begin auditing every New Yorker (alphabetically of course) until the citizens rise up against the intrustive and burdensome tax laws...
Editor's Note: If you look on a sales tax form, there is a separate area for filling out use tax. It can be used for a vendor who purchases items that are both taxable/non-taxable at an auction- he can pay no sales tax while at the auction and then report in the sales tax due for items taken out for personal use- or similarly if a vendor buys 20 of an item to sell and pays no sales tax at time of purchase, and keeps one for himself, he owes "use tax" on the one as he never paid tax. There is another area- let's say I buy a computer for resale for $100, but use it for six months and then sell for $75. I owe "use tax" on the value that I used. Similarly, if I buy from out of state and it is not consumed out of state (ie- meals are excluded, etc- but if I buy a computer for example), I am required by law to pay New York State sales tax on this. This also applies to mail order- if you buy something from LL Bean, or from eBay, you are legally required to pay sales tax on this. Sales tax law has the ability to catch a lot of people, if it were applied...which I am 100% for doing. My reasoning is that once regular people get caught in the web, the laws will have to be simplified and the tax rates will be much lower- but ignorance of the law keeps the status quo.

Utah's state income tax forms ask for a listing of all items purchased out of state. Funny thing, I NEVER buy ANYTHING outside of Utah, if you know what I mean. :)

You don't even have to look at out of state purchases. What about cigarets and gas bought on Indian reservations?
